Section 108-44 of Rye, N.Y., Code of Ordinances Chapter 108 places a broad set of maintenance and operational responsibilities squarely on lodging-house operators. The rule covers everything from capping occupancy at permitted levels and keeping common areas sanitary, to maintaining plumbing and appliances, clearing exits, managing garbage, controlling pests, and installing or removing required window screens. These duties apply to the premises as a whole, not just individual rooms, and are the operator's obligation regardless of what any individual occupant does.

For Property Managers

Operators of lodging houses in Rye should treat § 108-44 as a compliance checklist that runs continuously, not just at move-in. A compliant operator typically conducts regular inspections to confirm occupancy stays within permitted limits, that plumbing, cooking, and refrigeration equipment remains functional and clean, that exits are never blocked, and that pest control and garbage disposal programs are active. Keeping dated maintenance logs and screen installation records can help demonstrate ongoing adherence to each of the nine enumerated duties under this section.

For Tenants

Residents of lodging houses in Rye benefit from § 108-44 because it places the burden of maintaining safe, sanitary, and properly equipped premises on the operator, not the occupant. If conditions such as pest infestations, blocked exits, broken plumbing, or unsanitary common areas arise, tenants may have grounds to raise the operator's failure to comply with Chapter 108 when pursuing a remedy. General options available to tenants include contacting the City of Rye's code enforcement office to report violations, consulting a local tenant-rights organization, or seeking guidance from a housing attorney about how this provision applies to their situation.
