Rye, N.Y., Code of Ordinances ch. 108 § 108-21
Prevention of fire spread
Operative Text
A. Walls and ceilings shall be maintained free from cracks and openings which would permit flame or excessive heat to enter the concealed space. B. In buildings of mixed occupancy, nonresidential space shall be separated from residential space by approved fire separations which will retard the spread of fire. C. Garages in or attached to a residential building shall be separated from other spaces in the building by approved fire separations which will retard the spread of fire and prevent flammable or toxic vapors originating within the garage from being transmitted to other parts of the building.
Rye, N.Y., Code of Ordinances ch. 108 § 108-21 establishes structural fire-safety requirements for residential buildings. Walls and ceilings must be kept free of cracks or openings that could let flames or excessive heat reach hidden spaces. In buildings that mix residential and nonresidential uses, approved fire separations must divide those areas, and garages that are part of or attached to a residential building must be similarly separated to block both fire spread and the migration of flammable or toxic vapors.
Plain English — not legal advice.
Operators of residential properties in Rye should treat § 108-21 as an ongoing maintenance standard, not a one-time construction requirement. Compliant property managers routinely inspect walls and ceilings for cracks or gaps, ensure that any mixed-use building maintains code-approved fire separations between residential and nonresidential areas, and verify that attached or interior garages have proper fire separations that also seal against vapor transmission. Keeping documentation of inspections and any remediation work supports a clear record of compliance.

Under Rye, N.Y., Code of Ordinances ch. 108 § 108-21, tenants in residential buildings have an interest in knowing that walls, ceilings, and any shared boundaries with garages or commercial spaces are properly maintained to limit fire and vapor hazards. If a tenant observes cracks, gaps, or missing fire separations that may violate this provision, general enforcement paths include reporting the condition to the City of Rye's code enforcement or building department. Tenants may also consult a local tenant-rights organization to understand how a documented violation might be raised in a housing or habitability proceeding.
