Under Rochester, N.Y., Code of Ordinances ch. 90 § 90-39, business permits for rental properties issued after the article's effective date are valid for one year from issuance and then expire automatically unless suspended or revoked earlier. The Commissioner is required to send a written notice of the upcoming expiration at least 60 days before that date. Only permit holders who submit a renewal application at least 30 days before expiration are permitted to keep operating after the expiration date while their renewal is being decided.
Plain English — not legal advice.
Rochester, N.Y., Code of Ordinances ch. 90 § 90-39 places the renewal burden squarely on the permit holder: compliant operators track their permit's one-year expiration date, watch for the Commissioner's 60-day notice letter, and submit a complete renewal application no later than 30 days before expiration. Filing on time is what preserves the legal right to continue operating past the expiration date while the renewal decision is pending. Operators who miss the 30-day filing window lose that continuity protection and may be required to cease operations at expiration.

Rochester, N.Y., Code of Ordinances ch. 90 § 90-39 establishes that a landlord's business permit expires annually and that operating without a valid or timely-renewed permit may constitute a code violation. Tenants who believe their landlord is operating with an expired permit—and who did not submit a renewal application by the required deadline—may have grounds to raise that status with the relevant Rochester municipal authority or a local tenant-rights organization. Reviewing the permit status and understanding the renewal timeline can be a useful starting point for tenants concerned about whether their building is being lawfully operated.
