Plain English

Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-89 establishes that property owners bear ultimate responsibility for compliance with local housing standards, even when operators or occupants also carry certain duties under the code. Private agreements between an owner and an operator or tenant cannot shift this legal responsibility away from the owner. Additionally, owners of multiple dwellings are specifically required to keep service facilities properly maintained and to supply adequate heat and hot water.

For Property Managers

Under § 121-89, property owners in Rensselaer remain the party accountable for housing-code compliance regardless of lease terms, management contracts, or other arrangements that delegate duties to operators or tenants. Compliant operators typically maintain documented inspection and maintenance schedules for service facilities, heating systems, and hot-water equipment in their multiple dwellings. Because private agreements do not insulate an owner from code liability, owners generally ensure that any third-party managers are contractually and operationally equipped to meet these standards on their behalf.

For Tenants

Section 121-89 of Rensselaer's housing code means that tenants in multiple dwellings have a right to adequate heat, hot water, and properly maintained service facilities, and the owner—not just a building manager—is ultimately responsible for delivering those conditions. If these standards are not being met, tenants can generally document the deficiency and report it to the local code enforcement office, which has authority over housing-standard violations under this chapter. Tenant-rights organizations in the Rensselaer area can help residents understand what options may be available, such as filing a formal complaint or raising a code violation in a housing proceeding.
