Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-85
Administrative liability
Operative Text
No officer, agent or employee of the City of Rensselaer, New York, shall be personally liable for any damage that may accrue to person or property as a result of any official determination, order or action required or permitted in the discharge of his duties under this code. Any suit brought against any officer, agent or employee of the City of Rensselaer, New York, as a result of any official determination, order or action required or permitted in the discharge of his duties under this code shall be defended by the Corporation Counsel until the final determination of the proceedings therein.
Section 121-85 of Rensselaer's Code of Ordinances (ch. 121) establishes a liability shield for city officers, agents, and employees acting in their official capacity under the housing code. When a city official makes a determination, issues an order, or takes an action that is required or permitted by the code, that individual cannot be held personally responsible for any resulting damage to persons or property. Additionally, if a lawsuit is filed against such an official arising from those official duties, the city's Corporation Counsel is required to defend that official through the conclusion of the legal proceedings.
Plain English — not legal advice.
Under § 121-85, landlords and property managers interacting with Rensselaer housing code officials should understand that those officials act with personal liability protection when carrying out their duties. This means that legal challenges to code enforcement actions are directed at the city as an institution rather than at individual inspectors or officers. Operators who believe an official determination or order was improper generally pursue remedies through the city's administrative or judicial review processes rather than by suing the individual official personally.

Section 121-85 of ch. 121 clarifies that Rensselaer city employees who enforce the housing code are shielded from personal liability for their official actions. For tenants, this means that if a code enforcement action—or inaction—causes harm, any legal claim would be directed at the city rather than at the individual officer or inspector involved. Tenants who believe a code enforcement decision has affected their housing situation may explore options such as filing a complaint with the city, raising the matter through administrative review channels, or consulting a tenant-rights organization familiar with Rensselaer municipal procedures.
