Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-75
Designation of unfit premises
Operative Text
Any premises within the scope of this code having any of the defects found in Subsections A through D below may be designated by the chief officer as unfit for human habitation, and a notice to such effect shall be posted upon the premises. A. The structure lacks ventilation, sanitation, heat or other facilities adequate to protect the health and safety of the occupants or the public. B. The structure or premises is damaged, decayed, dilapidated, insanitary, unsafe or vermin-infested in such a manner as to create a serious hazard to the health and safety of the occupants or the public. C. The structure or premises, because of the location, general conditions, state of the premises or number of occupants, is so insanitary, unsafe, overcrowded or otherwise detrimental to health and safety that it creates a serious hazard to the occupants or the public. D. The structure, because of the failure of the owner or occupant to comply with such notices or orders issued pursuant to this code, is unfit for human habitation.
Under Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-75, the city's chief officer has authority to formally designate a property as unfit for human habitation when it meets one or more of four defined conditions: inadequate ventilation, sanitation, heat, or safety facilities; physical damage, decay, or vermin infestation creating a serious hazard; overcrowding or general conditions that are seriously detrimental to health and safety; or an owner's or occupant's failure to comply with prior code notices or orders. Once such a designation is made, a notice must be posted on the property itself. This provision applies to all premises covered by the city's housing code.

Property owners and managers subject to Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-75 generally maintain their buildings in a condition that avoids the four categories of defects that can trigger an 'unfit for human habitation' designation — adequate ventilation, heat, sanitation, and structural soundness are among the baseline expectations. Compliant operators also respond promptly to any notices or orders issued under the code, since failure to do so is itself an independent ground for an unfit designation under Subsection D. Keeping records of maintenance, repairs, and correspondence with city officials can help demonstrate ongoing compliance with the code's requirements.

Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-75 establishes that tenants living in premises with serious deficiencies — such as lack of heat, vermin infestation, structural decay, or dangerous overcrowding — may be protected by the city's authority to formally designate those premises as unfit for human habitation. If a tenant believes their home meets one of the four conditions described in this provision, they may consider contacting the city's code enforcement office to request an inspection, or reaching out to a local tenant-rights organization for information about available options. A formal unfit designation, including the required posted notice, can also be relevant in other legal or administrative proceedings related to the condition of the premises.
