Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-4
A. The provisions of this Part 1 shall supersede local laws, ordinances, codes or regulations to the extent that such laws, ordinances, codes or regulations are inconsistent with the provisions of this chapter, provided that nothing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance, code or regulation which is more restrictive or establishes a higher standard than those provided in this chapter, and such more restrictive requirement or higher standard shall govern during the period in which it is in effect. B. Where a provision of this chapter is found to be in conflict with a provision of a zoning, building, electrical, plumbing, fire, safety, health, water supply or sewage disposal law or ordinance, or regulation adopted pursuant thereto, or other local law, ordinance, code or regulation, the provision or requirement which is the more restrictive or which establishes the higher standard shall prevail.

Plain English

Section 121-4 of Rensselaer's Code of Ordinances, Chapter 121, establishes a hierarchy for resolving conflicts between this chapter's housing regulations and other local rules. When this chapter's provisions clash with other local laws, ordinances, or codes, the more restrictive requirement or the one setting the higher standard takes precedence. This means that neither this chapter nor any conflicting rule automatically wins out; whichever imposes the stricter obligation governs for as long as it remains in effect.

For Property Managers

Under § 121-4, property owners and managers operating in Rensselaer must identify which applicable regulation—whether from Chapter 121 or another local code such as a zoning, building, plumbing, or fire ordinance—sets the stricter standard, and then comply with that stricter standard. Compliant operators generally audit their properties against all potentially overlapping local requirements rather than assuming Chapter 121 alone defines their obligations. When a more restrictive local rule is in effect, that rule governs operations during that period, regardless of what Chapter 121 itself specifies.

For Tenants

Section 121-4 means that tenants in Rensselaer may benefit from whichever local regulation—Chapter 121 or another applicable code—provides the stronger protection or higher standard. If a landlord claims compliance with one set of rules while a stricter overlapping ordinance also applies, tenants can raise the more protective provision as relevant to any complaint or proceeding. Tenant-rights organizations or local code enforcement offices can help identify which standard applies in a given situation involving this chapter.
