Plain English

Section 121-22 of Rensselaer's Code of Ordinances establishes safety standards for fireplaces and similar open-burning fixtures in residential and other structures. The rule requires that fireplaces connect to approved chimneys, that all flame-exposed components be made of heat-resistant materials that won't degrade under high temperatures, and that decorative wood elements like mantels and trim be positioned so they cannot reach unsafe temperatures or catch sparks. Together, these requirements are designed to prevent structural fires and heat damage caused by improperly built or installed fireplace assemblies.

For Property Managers

Property owners and managers subject to Rensselaer Code ch. 121 § 121-22 generally ensure that any fireplace or open-burning fixture on their property is connected to a properly approved chimney and that all installation work keeps nearby combustible materials and structural members away from unsafe heat levels. Compliant operators verify that flame-exposed hearth components and linings are constructed from materials rated to withstand high temperatures without melting, spalling, or disintegrating. Wood mantels and trim are typically secured at distances and in configurations that prevent ignition from sparks or embers, and documentation of compliant installation is commonly retained for inspection purposes.

For Tenants

Tenants living in units with fireplaces in Rensselaer have an interest in knowing that § 121-22 sets baseline safety standards for fireplace construction, chimney connections, and the placement of combustible decorative elements like wood mantels. If a fireplace appears to have deteriorating hearth materials, an unapproved chimney connection, or a mantel positioned dangerously close to the firebox, these conditions may constitute code violations that can be reported to the appropriate local code enforcement authority. Tenants can also consult a tenant-rights organization or legal aid service to understand how a documented violation under ch. 121 might relate to habitability obligations or other remedies available under New York law.
