Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-19
Prohibited accumulation and storage
Operative Text
It shall be prohibited to: A. Accumulate or store on residential premises, except in approved locations, any highly flammable or explosive matter, such as paints, volatile oils, cleaning fluids and similar materials, or any combustible refuse liable to spontaneous combustion, such as wastepaper, boxes, rags or similar materials. B. Accumulate or store materials on fire escapes or stairs, in stairways or passageways, at doors or windows or in any other locations where in the event of fire such materials may obstruct egress of occupants or interfere with fire-fighting operations.
Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-19 prohibits two categories of hazardous storage in residential settings. First, it bars keeping highly flammable or explosive materials—such as paints, volatile oils, and cleaning fluids—or combustible refuse prone to spontaneous ignition anywhere on residential premises except in specifically approved locations. Second, it forbids placing any materials on fire escapes, stairs, stairways, passageways, doorways, or windows where those materials could block occupants from exiting or hinder firefighting efforts during an emergency.
Plain English — not legal advice.
Operators of residential properties subject to § 121-19 of Rensselaer's Code of Ordinances generally maintain designated, approved storage areas for flammable or explosive substances and ensure that no combustible refuse accumulates in unapproved spaces. Compliant property managers routinely inspect fire escapes, stairways, passageways, and exit points to confirm they remain clear of stored materials at all times. Keeping records of approved storage locations and conducting periodic walkthroughs are practices commonly associated with meeting the requirements of this provision.

Under § 121-19 of Rensselaer's Code of Ordinances, tenants have an interest in knowing that their building's common areas—including stairways, fire escapes, and passageways—must be kept free of stored materials that could block escape routes or impede firefighting. If a tenant observes violations of this provision, general enforcement paths include reporting the condition to the City of Rensselaer's code enforcement office or contacting local fire safety authorities. Tenant-rights organizations can also help residents understand how this provision interacts with habitability standards and what options may be available when violations are identified.
