For Property Managers

Operators of rental properties and lodging houses in Rensselaer must ensure that their units comply with the use restrictions set out in ch. 121 § 121-10. Compliant operators generally designate spaces according to their permitted function — keeping kitchens, cellars, hallways, and other nonhabitable or public areas free from use as sleeping quarters or unauthorized dining areas. In lodging houses specifically, communal kitchens used for dining are generally maintained at or above 100 square feet, and lodging units themselves are not configured or marketed as spaces where meals are prepared or eaten.

For Tenants

Under Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-10, tenants have an interest in knowing that certain spaces — including cellars, kitchens, and nonhabitable or public areas — are legally prohibited from being rented or used as sleeping or living quarters. If a landlord is renting such a space as a habitable unit, that arrangement may constitute a code violation that tenants can raise with local housing or code enforcement authorities. Tenants who believe their unit violates these use restrictions may also consult a local tenant-rights organization to understand what options are generally available to them.
