Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-83
Depreciation of surrounding property
Operative Text
(a) Exterior property areas shall be so maintained as not to cause a substantial depreciation in property values in the immediate neighborhood. (b) Exterior property areas shall be kept free from objects, materials and conditions which will have an adverse effect on adjacent premises by reducing the desirability of living conditions in the immediate neighborhood and causing a substantial depreciation in property values.
Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-83 establishes that the exterior areas of a property must be maintained at a standard that does not substantially drag down property values in the surrounding neighborhood. The rule also prohibits allowing objects, materials, or conditions to accumulate on exterior areas when those items reduce the desirability of living conditions nearby or cause significant depreciation in neighboring property values. In effect, the provision ties individual property upkeep to the broader health of the immediate neighborhood.
Plain English — not legal advice.
Under ch. 12 § 12-83, compliant property operators generally keep exterior areas clear of debris, discarded materials, and other conditions that could visibly diminish the appeal or value of adjacent properties. Routine inspections of yards, walkways, and other exterior spaces help identify accumulations or deteriorating conditions before they rise to the level of a code concern. Documenting maintenance activities and promptly addressing exterior issues are practices commonly associated with meeting this standard.

Section 12-83 of the Poughkeepsie Code of Ordinances gives residents a basis to raise concerns when exterior property conditions on or near their rental are causing neighborhood depreciation or reducing desirability of living conditions. Tenants who observe such conditions may report them to the City of Poughkeepsie's code enforcement office, which is generally responsible for investigating property maintenance complaints. Consulting a local tenant-rights organization can help clarify what documentation to gather and what options may be available under this provision.
