Under Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-68, when a property owner or responsible party fails to comply with an outstanding notice or order—such as one requiring repairs, securing, vacating, or demolition—and the head of the Code Enforcement Agency determines that failure constitutes a nuisance, the agency is empowered to step in and carry out the necessary work itself. Before taking any such action, the agency must document its findings and formally notify the owner, occupant, lessee, or mortgagee in accordance with Section 12-34. Abatement cannot begin until at least 10 days after that notice has been served, giving affected parties a brief window before the agency acts.
