Operative Text
All departments, officials and employees of the city who have the duty or the authority to issue permits or licenses in regard to the construction, installation, repair, use or occupancy of dwellings, dwelling units, rooming houses or rooming units, equipment or facilities shall conform to the provisions of this Chapter, and no such permit or license shall be issued, if such would be in conflict with this Chapter, except as provided in Section 12-5 .
Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-6 establishes that any city permit or license related to the construction, installation, repair, use, or occupancy of dwellings, rooming houses, or related equipment must align with the standards set out in Chapter 12. A permit or license that would conflict with Chapter 12 cannot be issued, with the limited exception described in Section 12-5.
Plain English — not legal advice.
Under Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-6, property owners and managers seeking permits or licenses for construction, installation, repair, or occupancy of dwellings or rooming units can expect city departments to evaluate those applications against Chapter 12's requirements. A compliant operator generally ensures that proposed work or use meets Chapter 12 standards before submitting applications, since a conflicting permit cannot lawfully be issued. Reviewing Section 12-5 is also relevant, as it outlines the narrow circumstances under which exceptions may apply.
