Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-175 establishes a local prohibition on eviction without good cause, adopted under New York State's Real Property Law Article 6-A. The rule carves out an exemption for rental units whose monthly rent exceeds 345% of the HUD-published fair market rent for Dutchess County, as further published by the New York State Division of Housing and Community Renewal. It also defines a 'small landlord' under this Division 9 as one who owns no more than one rental unit anywhere in New York State, a classification that may affect how other provisions of the division apply.

For Property Managers

Under § 12-175, operators of rental housing in Poughkeepsie are generally subject to good-cause eviction protections unless a specific exemption applies to their unit or their status. Landlords whose units carry a monthly rent above 345% of the applicable HUD fair market rent for Dutchess County may fall outside Division 9's requirements, and those who own only a single rental unit statewide may qualify as a 'small landlord' under the local definition. Compliant operators typically track current HUD fair market rent figures and their total unit count across New York State to understand which provisions of Division 9 apply to them.

For Tenants

Section 12-175 of the Poughkeepsie Code of Ordinances gives tenants in qualifying units a baseline protection against eviction without good cause, grounded in New York's Real Property Law Article 6-A. Tenants whose rent is at or below 345% of the HUD fair market rent for Dutchess County, and whose landlord owns more than one unit statewide, are more likely to fall within the division's protections. Tenants who believe a landlord has not complied with Division 9 may consider raising the good-cause requirement as a defense in eviction proceedings, filing a complaint with a relevant housing authority, or reaching out to a local tenant-rights organization for general information.
