Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-153
(a) Every habitable room shall have at least one window or skylight facing directly to the outdoors. The minimum aggregate area available for unobstructed light shall be not less than 8% of the floor area of such rooms. (b) Whenever walls or other portions of structures face the window of a habitable room and the ratio of the distance between the window and the obstruction and the height of the obstruction above the window sill is greater than one to six, such window shall not be deemed to face directly to the outdoors or be included as contributing to the total window area. These regulations shall not be interpreted as applicable to new construction under any circumstances.

Plain English

Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-153 establishes that every habitable room in existing buildings must have at least one window or skylight that opens directly to the outside, with the total unobstructed light-admitting area equaling at least 8% of the room's floor area. A window that faces a nearby wall or structure too closely — specifically where the distance-to-obstruction-height ratio exceeds one-to-six — does not count toward that requirement. This provision applies only to existing structures and is explicitly excluded from applying to new construction under any circumstances.

For Property Managers

Operators of existing residential properties in Poughkeepsie should verify that each habitable room meets the natural light standard set out in ch. 12 § 12-153, meaning each room has at least one qualifying window or skylight whose aggregate unobstructed area equals or exceeds 8% of the room's floor area. When a window faces an adjacent wall or structure, compliant operators assess the distance-to-height ratio to confirm the window qualifies under the one-to-six rule before counting it toward the total. Maintaining documentation of window measurements and room floor areas can help demonstrate compliance during inspections of existing units.

For Tenants

Under Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-153, tenants in existing residential buildings have a right to habitable rooms with adequate natural light — at least one qualifying window or skylight covering 8% of the floor area. If a room appears to lack sufficient natural light or has windows blocked by nearby structures that may disqualify them under the distance-to-height rule, tenants may consider documenting the conditions and reaching out to the city's code enforcement or housing inspection office to report a potential violation. Tenant-rights organizations familiar with Poughkeepsie housing code can help residents understand what options are generally available when a habitable room may not meet this standard.
