For Property Managers

Under ch. 12 § 12-104 of the Poughkeepsie Code of Ordinances, compliant property operators routinely inspect chimneys, flues, and vents to confirm they are structurally intact, free of cracks or blockages, and producing adequate draft for connected heating equipment. Operators generally document inspections and any remediation work, particularly for flue linings, to demonstrate ongoing compliance. Engaging a qualified chimney or HVAC professional to assess these systems on a regular schedule is a common practice among operators seeking to meet the smoketight and structural-safety standards the provision describes.

For Tenants

Section 12-104 of the Poughkeepsie Code of Ordinances gives occupants of residential structures a basis to expect that chimneys, flues, and vents are maintained in safe, defect-free, and fully functional condition. If a tenant observes signs of chimney deterioration, inadequate draft, smoke infiltration, or related hazards, general enforcement paths include notifying the landlord in writing and contacting the appropriate Poughkeepsie housing or code enforcement office to request an inspection. Tenant-rights organizations can help residents understand how a violation of § 12-104 might be raised in housing proceedings or used to support other remedies available under local and state law.
