Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-4
Compliance required
Operative Text
No person shall occupy as owner-occupant or let or rent to another for occupancy any dwelling, rooming house, dwelling unit or rooming unit for the purpose of living, sleeping, cooking or eating therein which does not comply with the requirements of this chapter.
Section 319-4 of Port Jervis's housing code establishes a baseline occupancy standard: no dwelling, rooming house, dwelling unit, or rooming unit may be occupied or rented out unless it meets all requirements set forth in Chapter 319. This applies whether the occupant is the owner living on the premises or a tenant paying rent. The rule covers any space used for living, sleeping, cooking, or eating.

Under Port Jervis Code § 319-4, compliant property operators ensure that every dwelling or rooming unit meets all Chapter 319 standards before allowing any occupancy—whether by a paying tenant or by themselves as owner-occupants. This means conducting regular assessments of units used for living, sleeping, cooking, or eating to confirm ongoing compliance, not just at the time of initial rental. Operators who let or rent a non-compliant unit may be found in violation of this provision regardless of whether a tenant has already moved in.

Section 319-4 of the Port Jervis Code gives tenants a basis to raise concerns when a dwelling or rooming unit does not meet the requirements of Chapter 319, since no such unit is lawfully rentable in a non-compliant condition. Tenants who believe their unit falls short of these standards may consider contacting the Port Jervis code enforcement office to request an inspection. Tenant-rights organizations can also help residents understand what Chapter 319 requires and what options may be available when a unit does not meet those requirements.
