Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-3
Scope
Operative Text
Every building used in whole or in part as a dwelling unit or as two or more dwelling units, or used in whole or in part as a rooming house, shall conform to the requirements of this chapter irrespective of other uses in such building and irrespective of when such building may have been constructed, altered or repaired.
Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-3 establishes that the housing standards set out in Chapter 319 apply broadly to any building that contains even a single dwelling unit or a rooming house, regardless of what other purposes the building may serve. The rule's reach is not limited by a building's age or by any prior construction, alteration, or repair work. In other words, no building used for residential purposes is exempt from the chapter's requirements simply because it was built or renovated before the code was adopted.
Plain English — not legal advice.
Under Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-3, operators of any property that includes residential use — whether a single dwelling unit, multiple units, or a rooming house — are generally expected to bring and keep the entire building into compliance with Chapter 319's standards. Compliant operators do not rely on a building's construction date or past renovation history as a basis for exemption. Mixed-use properties, such as buildings that combine commercial and residential space, are also subject to the chapter's requirements with respect to their residential portions.
