Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-21
Notification of decisions; contents of notice; records
Operative Text
All decisions of the Board shall be in writing, and a copy of each decision shall be sent to the applicant and to the enforcement officer. The Board shall also retain in its files a copy of each decision, which files shall be available for inspection by the public. Each decision shall set forth fully the reasons for the decision of the Board and the findings of fact on which the decision was based.
Under Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-21, every decision issued by the Board must be documented in writing and must fully explain the reasoning and factual findings behind it. Copies of each decision are sent to the applicant and the enforcement officer, and the Board keeps its own copy on file. Those files are open to the public for inspection, creating a transparent record of Board actions.
Plain English — not legal advice.
Property owners and managers who appear before the Board under ch. 319 § 319-21 can expect to receive a written copy of any decision, complete with the Board's stated reasoning and factual findings. Compliant operators generally keep these written decisions in their own records alongside any related application materials. Because the Board's files are publicly accessible, operators can also review prior decisions to understand how the Board has reasoned through similar matters.

Section 319-21 of Port Jervis's Code of Ordinances gives tenants and members of the public the right to inspect the Board's decision files, which include the full reasoning and factual basis for each ruling. If a decision affects your housing situation, you are entitled to receive or review the written record, which can be a useful resource when evaluating next steps. Tenant-rights organizations can help explain how to access these public files or how a Board decision's stated findings might be relevant to a broader housing matter.
