Plain English

Peekskill, N.Y., Code of Ordinances ch. 332 § 332-3 establishes that owners, operators, and occupants bear responsibility for complying with the chapter's requirements based on their role or any applicable agreement. Owners carry a specific duty to keep service facilities properly maintained and functioning, and—unless a written agreement shifts the obligation—must supply adequate heat and hot water, except where individual unit systems exist. If an owner provides a refrigerator, that appliance must also be kept in working order, and any written agreement reassigning these duties must be filed with the Department of Public Works.

For Property Managers

Under Peekskill, N.Y., Code of Ordinances ch. 332 § 332-3, compliant property owners generally ensure that all service facilities—including heating systems, hot water supply, and any owner-provided refrigerators—are kept in proper operating condition throughout a tenancy. When an owner wishes to shift responsibility for heat or hot water to a tenant in writing, that agreement must be filed with the Department of Public Works to be effective under this chapter. Operators who document maintenance schedules, retain service records, and promptly address equipment failures tend to demonstrate the kind of ongoing compliance the provision contemplates.

For Tenants

Peekskill, N.Y., Code of Ordinances ch. 332 § 332-3 gives tenants a basis to expect that their landlord will maintain service facilities—including heat, hot water, and any owner-supplied refrigerator—in proper working condition unless a written, filed agreement provides otherwise. Tenants who experience failures in these services may consider documenting the issue in writing, notifying the owner, and contacting the City of Peekskill's Department of Public Works to understand available complaint or inspection processes. Local tenant-rights organizations can help residents understand how this provision may apply to their circumstances and what general enforcement paths exist.
