Peekskill, N.Y., Code of Ordinances ch. 332 § 332-17 establishes the conditions under which a building or property can be officially declared unfit for human habitation. The chief officer of the bureau holds the authority to make this designation when a structure lacks adequate ventilation, sanitation, heat, or safety measures; is damaged, decayed, or vermin-infested; is overcrowded or otherwise hazardous; or when an owner or occupant has failed to comply with prior notices or orders. Once designated, a notice must be physically posted on the premises to signal the official determination.
Plain English — not legal advice.
Under § 332-17, property owners operating within Peekskill's Uniform Code jurisdiction are generally expected to maintain structures with adequate ventilation, sanitation, heat, and safety conditions at all times. Compliant operators routinely address decay, pest infestations, structural damage, and overcrowding before conditions escalate to the point where the bureau's chief officer could designate the property unfit. Owners who receive notices or orders under this chapter and fail to act risk the property itself being cited under Subsection D as an independent basis for an unfit designation.

Section 332-17 of Peekskill's Code of Ordinances gives tenants a framework for understanding when their living conditions may legally qualify a property as unfit for human habitation. If a building lacks heat, sanitation, or safe structural conditions, or is vermin-infested or overcrowded, occupants may have grounds to bring those conditions to the attention of the bureau's chief officer, who has authority to post an official unfit designation. Tenants experiencing such conditions may also wish to consult a local tenant-rights organization or legal aid office to understand the range of options available under this provision.
