Under Peekskill, N.Y., Code of Ordinances ch. 155 § 155-8, residents of affordable or workforce housing units must have their income verified every two years, and their leases may run no longer than two years at a time. Tenants who remain income-eligible and comply with lease terms are entitled to be offered renewal leases on the same two-year maximum basis. If a tenant's income later rises above the program's allowable maximum, the tenant pays 30% of household income, with any amount exceeding the standard affordable or workforce rent directed into a city-managed affordable housing fund.

For Property Managers

Operators of affordable or workforce housing units in Peekskill are generally expected, under § 155-8, to conduct income certification for each occupant on a two-year cycle and to structure leases so that no single term exceeds two years. Compliant operators offer renewal leases to tenants who remain eligible and have honored their lease obligations. When a tenant's gross income surpasses the program ceiling, operators typically adjust rent to 30% of household income and remit the overage above the standard affordable or workforce rent to the City's affordable housing fund as required by § 155-8(C).

For Tenants

Section 155-8 of the Peekskill Code gives tenants in affordable or workforce housing the right to be offered renewal leases—each up to two years—so long as they remain income-eligible and have complied with their lease terms. Tenants should be aware that income is recertified every two years, and that exceeding the program's income limit triggers a rent adjustment to 30% of household income rather than automatic removal from the unit. Tenants who believe a renewal has been improperly withheld or that the income-certification process has not been followed correctly may wish to contact the City of Peekskill or a local tenant-rights organization for guidance on § 155-8.
