Plain English

Oneida, N.Y., Code of Ordinances ch. 77 § 77-8 establishes that property owners bear ultimate responsibility for complying with the chapter's requirements, even when operators or occupants also carry duties under the same chapter or under private agreements. Owners are additionally responsible for keeping service facilities properly maintained and functional, and—absent a written agreement shifting the duty—must supply adequate heat and hot water to units that lack individual heating or hot water systems. When an owner provides cooking or refrigeration equipment, that equipment must also be kept in proper working order.

For Property Managers

Under Oneida, N.Y., Code of Ordinances ch. 77 § 77-8, compliant property owners generally document any written agreements with tenants that reassign responsibility for heat or hot water in units with individual systems, since the default obligation rests with the owner. Operators who provide appliances such as stoves or refrigerators routinely inspect and service that equipment to keep it in proper operating condition. Owners should also be aware that private lease terms shifting maintenance duties to tenants or operators do not relieve the owner of statutory responsibility under this chapter.

For Tenants

Oneida, N.Y., Code of Ordinances ch. 77 § 77-8 gives tenants a basis to hold owners accountable for heat, hot water, and owner-supplied appliances regardless of what a lease may say about operator or tenant responsibilities. Tenants who experience failures in these areas may document the conditions in writing and contact the appropriate local code enforcement office to report a potential violation. Tenant-rights organizations in the Oneida area can help residents understand what remedies or complaint processes may be available under this provision.
