Oneida, N.Y., Code of Ordinances ch. 77 § 77-57
Disposal of sewage and septage
Operative Text
All sewage, wastewater and septage shall be discharged into a public sewer system pursuant to and except as otherwise provided by ordinance of the City. Notwithstanding any other provision of local or state law, no discharge of sewage, wastewater or septage shall be permitted upon the surface of the ground anywhere within the City or into natural or artificial surface drainageways. "Septage" is defined as the contents of a septic tank, cesspool or other individual sewage treatment facility which receives domestic sewage waste.
Oneida City Code ch. 77 § 77-57 establishes that all sewage, wastewater, and septage generated within the City of Oneida must be directed into the public sewer system, with limited exceptions set by city ordinance. The rule flatly prohibits discharging any of these materials onto the ground surface or into any drainage channel—whether natural or man-made—anywhere within city limits. 'Septage,' as defined in § 77-57, covers the contents of septic tanks, cesspools, and similar individual sewage treatment facilities that handle domestic waste.

Property owners and managers operating in Oneida are generally expected, under ch. 77 § 77-57, to ensure that all sewage, wastewater, and septage from their properties is routed exclusively through the public sewer system. Compliant operators confirm that no on-site discharge—such as surface dumping or drainage into ditches or waterways—occurs at any property they manage. Those with septic tanks or cesspools on-site should be aware that the contents of those systems (septage) fall squarely within the scope of this provision and must be handled accordingly.

Under Oneida City Code ch. 77 § 77-57, tenants have an interest in knowing that their dwelling's sewage and wastewater must be properly connected to the public sewer system, and that any surface discharge or drainage-channel discharge is prohibited. If a tenant observes what appears to be sewage, wastewater, or septage being discharged onto the ground or into a drainage channel at their property, that may constitute a violation of § 77-57 reportable to the appropriate city authority. Tenants can also reach out to local tenant-rights organizations to better understand how this provision intersects with habitability standards and what options may be available to them.
