Plain English

Section 77-31 of Oneida's Code of Ordinances, Chapter 77, establishes a coordination mechanism for housing violations that overlap with fire prevention or public health authority. When an alleged violation falls under the Bureau of Fire Prevention or the city's Sanitary Code and state public health laws, it is routed to the appropriate specialist officer—the Fire Chief or the Health Officer—for inspection and a written report back to the Agency's Chief Officer. The reporting officer must also indicate in writing whether the violation will be handled under the specialized code, under Chapter 77, or both, and any cooperative enforcement path must include the violation in all notices, orders, and legal proceedings.

For Property Managers

Property owners and managers subject to Chapter 77 of the Oneida Code of Ordinances should be aware that a single alleged violation may trigger inspections by more than one regulatory body. Under § 77-31, if a condition implicates fire prevention or sanitary and public health standards, both the relevant specialist officer and the Agency's Chief Officer may be involved in documenting and pursuing compliance. Operators generally maintain records of all written notices and orders received, since violations identified through this referral process are incorporated into any formal orders and legal proceedings that follow.

For Tenants

Section 77-31 of Oneida's Code of Ordinances, Chapter 77, means that tenants who report conditions involving fire hazards or sanitary and public health concerns may have their complaints reviewed by multiple city officers—the Fire Chief or Health Officer as well as the Agency's Chief Officer. The written reports generated through this referral process become part of the official record and must be included in any notices, orders, or legal proceedings under § 77-31. Tenants who believe a landlord is not complying with fire prevention or public health standards may consider contacting the relevant city office directly or reaching out to a local tenant-rights organization to understand how the referral and inspection process applies to their situation.
