Operative Text
An appeal from a determination of the enforcement officer may be taken by any aggrieved person or by any officer, department or board of the City to the Joint Zoning Board of Appeals/Planning Commission as provided in Chapter 190 , Zoning. Appeals shall be submitted to the enforcement officer, who shall then transmit to the Board all the papers constituting the record upon which the action appealed from was taken. The Joint Zoning Board of Appeals/Planning Commission shall have the powers and duties prescribed by statute, this chapter and Chapter 190 , Zoning.
Section 77-30 of Oneida's Code of Ordinances establishes a formal appeal pathway for anyone aggrieved by a decision made by the enforcement officer. Appeals are directed to the Joint Zoning Board of Appeals/Planning Commission, following the procedures set out in Chapter 190 (Zoning). The enforcement officer serves as the conduit, receiving the appeal and forwarding the complete record to the Board, which then exercises the powers granted to it by statute, this chapter, and Chapter 190.
Plain English — not legal advice.
Under § 77-30, property owners or managers who disagree with an enforcement officer's determination have a defined route to challenge that decision through the Joint Zoning Board of Appeals/Planning Commission. A compliant operator generally submits the appeal to the enforcement officer, who is responsible for transmitting the full record to the Board. Familiarity with the procedural requirements of Chapter 190 (Zoning) is important, as the Board's authority and process are governed by those provisions alongside § 77-30.

Section 77-30 gives any aggrieved person—including tenants affected by an enforcement officer's determination—the right to appeal that decision to the Joint Zoning Board of Appeals/Planning Commission. The appeal is submitted to the enforcement officer, who then forwards all relevant records to the Board for review. Tenants who believe an enforcement decision was incorrect may wish to consult a tenant-rights organization or legal aid provider to understand how the appeal process under Chapter 190 (Zoning) applies to their circumstances.
