Plain English

Oneida, N.Y., Code of Ordinances ch. 77 § 77-23 establishes the conditions under which a property can be officially labeled 'unfit for human habitation.' The Chief Officer of the Agency holds authority to make that designation and post a placard on the property when specific defects are present, such as missing basic utilities, structural decay, overcrowding, or an owner's failure to comply with prior orders. The rule applies to any premises covered by Chapter 77 and is intended to protect both occupants and the general public from serious health and safety hazards.

For Property Managers

Under Oneida, N.Y., Code of Ordinances ch. 77 § 77-23, compliant property operators generally maintain adequate illumination, ventilation, sanitation, and heat, and keep structures free from decay, vermin, and unsafe conditions. Operators also respond promptly to any notices or orders issued under Chapter 77, since failure to comply is itself a standalone ground for an 'unfit' designation. Keeping documentation of maintenance, repairs, and correspondence with the Agency can help demonstrate ongoing compliance with the conditions enumerated in § 77-23.

For Tenants

Oneida, N.Y., Code of Ordinances ch. 77 § 77-23 identifies specific conditions—such as lack of heat, structural decay, vermin infestation, or dangerous overcrowding—that can trigger an official 'unfit for human habitation' designation by the Chief Officer of the Agency. Tenants who believe their dwelling meets one or more of these conditions may report concerns to the Agency responsible for enforcing Chapter 77, which has authority to inspect and placard the property.
