Oneida, N.Y., Code of Ordinances ch. 77 § 77-19
Liability of City officers, employees, agents; defense and indemnification
Operative Text
No officer, agent or employee of the City shall be personally liable for any damage resulting from any official determination, order or action required or permitted in the discharge of his duties under this chapter. The City shall defend and indemnify the Chief Officer of the Agency and the Fire Chief or other officer of their departments or bureaus specifically designated and authorized by them to make such official determination, order or action in the discharge of their duties under this chapter, against any judgments or liability that may arise as a result of any such official determination, order or action made or taken by them in the discharge of their duties under this chapter.
Under Oneida, N.Y., Code of Ordinances ch. 77 § 77-19, city officers, agents, and employees are shielded from personal financial liability for damages that stem from official determinations, orders, or actions they carry out under this chapter. Beyond that individual protection, the City itself takes on the obligation to defend and indemnify the Chief Officer of the Agency, the Fire Chief, and any officers they specifically designate, against judgments or liability arising from those official acts. This provision is essentially a legal backstop ensuring that covered officials can carry out their duties without personal financial exposure.
Plain English — not legal advice.
For property owners and managers subject to enforcement actions under ch. 77 § 77-19, this provision clarifies that the city officials who issue orders or make determinations—such as the Fire Chief or the Chief Officer of the Agency—are acting under institutional protection, not personal risk. Compliant operators generally understand that challenging an official determination means engaging with the City as the responsible party, not the individual officer. Knowing this framework can inform how landlords approach administrative appeals or disputes arising from official orders under this chapter.

Section 77-19 of Oneida's Code of Ordinances ch. 77 establishes that city officials who make enforcement decisions under this chapter are indemnified by the City, meaning any legal challenge to their actions is effectively directed at the municipality rather than the individual officer. For tenants, this means that official orders or determinations issued under this chapter carry the full institutional weight of the City behind them. Tenants who believe an official action under this chapter has affected their rights may wish to consult a tenant-rights organization or legal aid resource to understand available administrative or legal avenues.
