For Property Managers

Under Oneida, N.Y., Code of Ordinances ch. 77 § 77-121, property owners and their agents bear direct responsibility for ensuring that gas appliances are properly installed with sufficient ventilation clearance and kept in good repair throughout the tenancy. Operators of buildings with water-cooled gas refrigerators should verify that those units include all required components—corrosion-resistant flues, fixed burner assemblies, pressure regulators, filters, thermostats, and automatic safety devices. Compliant operators typically conduct routine inspections of gas appliances and address any maintenance issues promptly to meet the ongoing 'good order and repair' standard the ordinance imposes.

For Tenants

Oneida, N.Y., Code of Ordinances ch. 77 § 77-121 establishes that tenants living in buildings with gas appliances have an interest in those appliances being properly installed and continuously maintained in good working order. If a gas appliance in a rental unit appears to be poorly ventilated, in disrepair, or missing required safety components, tenants may have grounds to raise the landlord's failure to comply with this provision when pursuing remedies through local code enforcement or housing authorities. Tenant-rights organizations can help residents understand what documentation to gather and what local complaint processes may be available.
