Oneida, N.Y., Code of Ordinances ch. 77 § 77-12
A. The provisions of this chapter shall supplement local laws, ordinances, codes or regulations. When a provision of this chapter is found to be inconsistent with any provisions of a statute, local law, ordinance, code or regulations, the provisions or requirement which is the more restrictive or which establishes the highest standard shall prevail. A greater penalty shall not be considered as more restrictive or a higher standard. B. Notwithstanding the availability of other remedies for enforcement of the provisions contained in the New York State Uniform Fire Prevention and Building Code, Sanitary Code and Zoning Ordinances of the City, the remedies and enforcement procedures as set forth in this chapter may be used to enforce the provisions of the aforesaid enumerated City codes and ordinances and shall be deemed cumulative to other procedures and remedies.

Plain English

Section 77-12 of Oneida's Code of Ordinances establishes two key rules about how Chapter 77 interacts with other laws. First, when Chapter 77 conflicts with another statute, ordinance, or regulation, the stricter standard—not the harsher penalty—takes precedence. Second, the enforcement tools and remedies available under Chapter 77 can also be used to enforce the New York State Uniform Fire Prevention and Building Code, the Sanitary Code, and the City's Zoning Ordinances, and these remedies stack on top of whatever other enforcement options already exist.

For Property Managers

Property owners and managers operating in Oneida should be aware that under § 77-12, compliance with Chapter 77 does not automatically satisfy other applicable codes—if a conflicting provision in another ordinance or regulation sets a stricter substantive standard, that higher standard governs. Operators generally track requirements across Chapter 77, the State Uniform Fire Prevention and Building Code, the Sanitary Code, and local Zoning Ordinances simultaneously, since § 77-12 makes the enforcement mechanisms of Chapter 77 available for all of those codes. Because penalties alone do not determine which rule is 'more restrictive' under this section, the focus for compliance purposes is on the substantive requirements themselves.

For Tenants

Under § 77-12, tenants in Oneida benefit from a framework that applies the strictest applicable housing, fire, sanitary, and zoning standards to their living conditions, regardless of which specific code contains them. The provision also means that the enforcement procedures of Chapter 77 can be invoked to address violations of the State Uniform Fire Prevention and Building Code, the Sanitary Code, and City Zoning Ordinances—expanding the avenues through which code issues may be pursued. Tenants who believe a violation exists may consider raising the relevant code standard as a defense in a proceeding, filing a complaint with the appropriate City department, or consulting a local tenant-rights organization to understand which enforcement path fits their situation.
