Section 77-115 of Oneida, N.Y., Code of Ordinances ch. 77 establishes safety standards for fireplaces and similar open-burning fixtures in residential and other structures. The rule requires that such fixtures connect to approved chimneys, that all flame-exposed components be made of heat-resistant materials that won't melt, crack, or shatter, and that wood mantels and trim be positioned so they cannot reach unsafe temperatures or be ignited by sparks or embers. The provision is designed to reduce fire hazards and structural damage associated with improperly installed or constructed fireplaces.

For Property Managers

Property owners and managers operating under Oneida, N.Y., Code of Ordinances ch. 77 § 77-115 are generally expected to ensure that any fireplace or open-burning fixture on the premises is connected to a code-approved chimney and that all installation work keeps nearby combustible materials and structural members away from unsafe heat levels. Compliant operators typically verify that hearth linings and other flame-exposed components are constructed from materials rated to withstand high temperatures without melting, spalling, or shattering. Wood mantels and decorative trim should be secured at distances and in configurations that prevent ignition from sparks or embers, a detail often confirmed during routine inspections or when preparing a unit for occupancy.

For Tenants

Tenants living in a unit with a fireplace have an interest in knowing that § 77-115 of Oneida's Code of Ordinances ch. 77 sets baseline safety requirements for how fireplaces must be built and maintained. If a fireplace appears to have cracked or deteriorating linings, an unapproved chimney connection, or wood trim that shows signs of heat damage or scorching, these conditions may represent a code violation that a tenant can document and report to the local code enforcement or building department. General enforcement paths available to tenants include filing a complaint with the appropriate municipal authority, raising the condition in communications with the landlord in writing, or reaching out to a local tenant-rights organization for guidance on next steps.
