Plain English

Section 77-101 of Oneida's Code of Ordinances requires that exterior stairs, porches, and railings on any residential structure be maintained in good repair and remain structurally sound. Railings must be installed on stairs and balconies, and also on porches or accessible roofs where safety conditions call for them. A stair or porch meets the standard when it is free of holes and cracks and can bear the loads placed on it; railings must be properly balustraded and load-bearing wherever a clear danger of accident or injury exists.

For Property Managers

Under § 77-101, compliant property operators routinely inspect exterior stairs, porches, and railings for holes, cracks, or structural weakness and address deficiencies promptly. Operators ensure that railings are installed on all exterior stairs and balconies, and evaluate porches and accessible roofs to determine whether the danger of accident requires balustrades as well. Maintaining documentation of inspections and repairs can help demonstrate ongoing compliance with the structural soundness standard set out in this section.

For Tenants

Section 77-101 establishes a right to exterior stairs, porches, and railings that are structurally sound and free of hazards such as holes, cracks, or missing balustrades. Tenants who observe conditions that appear to fall short of this standard—such as unstable railings or deteriorating porch surfaces—may report concerns to Oneida's local code enforcement or housing inspection office. Tenant-rights organizations can help residents understand what documentation to gather and what general options exist for pursuing a complaint under this provision.
