A room rented to a single occupant must have at least 90 square feet of gross floor area for sleeping purposes, while rooms shared by multiple occupants must provide at least 70 square feet per person. Operators of rooming houses and rental units in Newburgh should ensure that each unit meets the space thresholds set out in ch. 190 § 190-96 before placing any occupant in a room. Compliant operators calculate usable floor area carefully, excluding any portions of the room where the ceiling falls below five feet, and verify that at least half the floor area has a ceiling height of seven feet or more. Keeping records of room dimensions and occupancy limits helps demonstrate ongoing compliance with these standards.

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-96, tenants have a right to occupy sleeping rooms that meet minimum size and ceiling-height requirements. If a room appears to fall short of the 90-square-foot single-occupant standard or the 70-square-foot-per-person standard for shared rooms, tenants may consider documenting the dimensions and reporting the condition to the appropriate local code enforcement authority. Tenant-rights organizations in the Newburgh area can help residents understand what options are available, including raising a housing code violation as part of a broader housing complaint.
