For Property Managers

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-67, compliant residential property operators generally ensure that below-grade spaces such as cellars, basements, and crawl spaces are maintained in a dry, well-ventilated condition. This typically involves installing and maintaining vents, windows, or openings near each corner of the structure and verifying that the aggregate ventilation area meets the code's minimum square-footage thresholds. Routine inspections of these spaces for moisture intrusion, blocked vents, or deteriorating materials are a common part of responsible property management under this provision.

For Tenants

Newburgh, N.Y., Code of Ordinances ch. 190 § 190-67 gives tenants a basis to raise concerns if a residential structure's cellar, basement, or crawl space is excessively damp or lacks adequate cross ventilation, as these conditions may indicate a code violation. Tenants who observe persistent moisture, mold, or blocked vents in these areas may consider documenting the conditions and reporting them to the appropriate Newburgh housing or code enforcement authority. Tenant-rights organizations familiar with local housing codes can help residents understand what options may be available when conditions appear to fall short of the standards set by this provision.
