Newburgh, N.Y., Code of Ordinances ch. 190 § 190-5
Applicability to all dwellings
Operative Text
Every portion of a building or premises used or intended to be used for any dwelling purpose, except temporary housing, shall comply with the provisions of this chapter, irrespective of when such building shall have been constructed, altered or repaired and irrespective of any permits or licenses which shall have been issued for the use or occupancy of the building or premises, for the construction or repair of the building or for the installation or repair of equipment or facilities prior to August 1, 1959. This chapter establishes minimum standards for the initial and continued occupancy of all buildings and does not replace or modify standards otherwise established for the construction, repair, alteration or use of building equipment or facilities except as provided in § 190-7 .
Newburgh, N.Y., Code of Ordinances ch. 190 § 190-5 establishes that virtually every residential dwelling in Newburgh must meet the minimum housing standards set out in Chapter 190, regardless of when the building was constructed, altered, or repaired. The age of a structure or the existence of older permits and licenses issued before August 1, 1959 does not exempt a property from compliance. The chapter sets a baseline for both initial and ongoing occupancy conditions, and it operates alongside—rather than replacing—other applicable construction or equipment standards, except where § 190-7 provides otherwise.

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-5, compliant property owners and managers maintain their residential units in accordance with Chapter 190's minimum standards regardless of how old the building is or what permits were historically issued. Operators generally conduct regular inspections and address maintenance issues to ensure continued compliance, since the rule applies to ongoing occupancy—not just the moment a tenant moves in. Relying on pre-August 1, 1959 permits or licenses as a basis for exemption is not a recognized defense under this provision.

Newburgh, N.Y., Code of Ordinances ch. 190 § 190-5 gives tenants the assurance that minimum housing standards apply to their dwelling no matter when it was built or what historical permits were issued for it. If conditions in a rental unit appear to fall below those minimum standards, tenants may have grounds to raise a violation of Chapter 190 as part of a housing complaint or as a defense in certain legal proceedings. Tenant-rights organizations and local housing authorities in Newburgh can provide general information about how to document conditions and what complaint or enforcement pathways may be available.
