Plain English

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-32, a dwelling, dwelling unit, rooming house, or rooming unit can be officially designated as unfit for human habitation if it falls into one or more of four categories: lacking basic facilities such as light, ventilation, heat, or sanitation; being in a deteriorated or vermin-infested condition that poses a serious health or safety hazard; presenting detrimental conditions due to location, overcrowding, or general state of the premises; or remaining out of compliance with previously issued notices or orders under this chapter. Once designated, the property may be placarded accordingly by the head of the code enforcement agency. This provision establishes the grounds on which such a designation can be made, not the procedures that follow.

For Property Managers

Property owners and managers subject to Newburgh, N.Y., Code of Ordinances ch. 190 § 190-32 generally maintain their properties in a condition that avoids the four enumerated defect categories — ensuring adequate illumination, ventilation, sanitation, and heat; keeping structures free of decay, damage, and vermin; preventing overcrowding or other detrimental site conditions; and promptly responding to any notices or orders issued under Chapter 190. Failure to address any of these conditions can result in the head of the code enforcement agency designating the property unfit for human habitation and posting a placard. Compliant operators typically document maintenance activities and keep records of any correspondence with code enforcement to demonstrate ongoing responsiveness.

For Tenants

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-32, tenants living in dwellings or rooming units that lack adequate facilities, are in deteriorated or vermin-infested condition, present overcrowding or other detrimental conditions, or are subject to unaddressed code violations may have grounds to request that the city's code enforcement agency inspect and potentially designate the property as unfit for human habitation. A formal designation and placarding under this section can be relevant in housing court proceedings or other enforcement contexts. Tenants who believe their unit may meet one of the four enumerated defect categories can contact Newburgh's code enforcement agency or a local tenant-rights organization to understand what options may be available to them.
