When two or more dwelling units within a building are so infested, it shall be the responsibility of the owner to carry out the provisions of this chapter within such building as cited above with respect to extermination.

Plain English

Under Newburgh, N.Y., Code of Ordinances ch. 190 § 190-110, responsibility for pest extermination in a dwelling depends on the type of building and the scope of the infestation. In a single-unit dwelling, the occupant bears full responsibility for extermination. In a multi-unit building, the occupant is responsible only when their unit is the sole infested one—unless the infestation stems from the owner's failure to comply with related code provisions—and the owner becomes responsible whenever two or more units in the same building are infested.

For Property Managers

Property owners and managers operating multi-unit buildings in Newburgh should be aware that § 190-110 assigns extermination responsibility to the owner whenever two or more units are infested, or whenever an infestation in a single unit is traceable to the owner's failure to meet obligations under §§ 190-52, 190-64, and 190-74. Compliant operators typically conduct regular inspections, address building-wide conditions that could harbor pests, and respond promptly when multiple units report infestations. Maintaining documentation of maintenance and extermination efforts can help demonstrate compliance with the chapter's requirements.

For Tenants

Under § 190-110, tenants in multi-unit Newburgh buildings have a basis to assert that extermination is the owner's responsibility when more than one unit is infested, or when the infestation results from the owner's failure to fulfill duties under related code sections. Tenants who believe an owner is not meeting these obligations may consider filing a complaint with the City of Newburgh's code enforcement office or consulting a local tenant-rights organization for guidance on available options. Keeping written records of reported infestations and any owner responses can be useful when pursuing a complaint or raising a code violation.
