Plain English

New Rochelle Code ch. 174 § 174-5 establishes mutual access rights for residential properties. Authorized city inspectors may enter dwellings, dwelling units, rooming houses, and their premises—generally between 8:00 a.m. and 5:00 p.m.—to assess housing conditions, with exceptions for emergencies or other legal authority. Owners, operators, and occupants are required to allow inspectors free access, and occupants must also allow owners or their agents entry at reasonable times to make repairs or alterations needed to comply with the chapter's requirements.

For Property Managers

Under New Rochelle Code ch. 174 § 174-5, compliant property owners and operators provide city inspectors unobstructed access during the standard 8:00 a.m.–5:00 p.m. window and cooperate during emergency inspections when required. Owners also have a corresponding right to enter occupied units at reasonable times to perform repairs or alterations necessary to meet the chapter's housing standards. Operators generally document access requests and completed repairs to demonstrate ongoing compliance with the ordinance.

For Tenants

New Rochelle Code ch. 174 § 174-5 gives occupants a degree of predictability around inspections, as city inspectors are ordinarily limited to the 8:00 a.m.–5:00 p.m. timeframe except in emergencies or other legally recognized circumstances. Occupants are required to allow both city inspectors and property owners or their agents reasonable access for compliance-related repairs, but the provision's scheduling norms offer some structure around when such visits typically occur. Tenants who believe access rights under § 174-5 are being misused or that inspections are being conducted improperly may consider contacting the New Rochelle Building Department or a local tenant-rights organization to understand available options.
