New Rochelle, N.Y., Code of Ordinances ch. 174 § 174-4

Operative Text
A. The service of orders for the correction of violations of this code or of any notices provided for in this code or required herein shall be made upon the owner of the premises involved, unless the premises is owned by one person and occupied by another, and, in such case, upon the owner and the occupant or tenant thereof or the managing agent of the premises. Service may be made upon such person personally or by registered mail directed to the last known address or, in the case of an owner, to the mailing address given in the records of the tax office of the City of New Rochelle to which tax bills relating to the property involved are mailed. B. C. The owner of a premises who does not reside in Westchester County shall designate a local representative in Westchester County to receive service of orders made under this chapter.
New Rochelle Code of Ordinances ch. 174 § 174-4 establishes how official correction orders and notices must be delivered to the parties responsible for a property. When a property is owned by one person and occupied by another, both the owner and the occupant or tenant (or the managing agent) must receive service, either in person or by registered mail to their last known address or the tax-record mailing address. Owners who live outside Westchester County are required to designate a local Westchester County representative to accept service on their behalf.

Under ch. 174 § 174-4, compliant property owners and managers ensure that their current mailing address is accurately reflected in New Rochelle's tax office records, since that address is a valid channel for official service of correction orders. Owners residing outside Westchester County generally maintain a designated local representative within the county who is authorized to receive service of orders issued under this chapter. When a property is leased, operators typically ensure that both the owner and the occupant are identified and reachable, since Fire Prevention Code enforcement orders apply to both parties.

Section 174-4 of the New Rochelle Code of Ordinances means that when a property is rented, tenants or occupants are entitled to receive official correction orders and notices directly—not just the owner—giving tenants formal notice of any violations being addressed at their residence. If a tenant believes proper service was not made or that violations are going unaddressed, they may raise the procedural requirements of § 174-4 as part of any complaint or proceeding before the relevant local authority. Tenant-rights organizations familiar with New Rochelle housing regulations can help explain what options are generally available when service or enforcement obligations under this provision appear to have been overlooked.
