New Rochelle, N.Y., Code of Ordinances ch. 132 § 132-2
If any provision of this chapter is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, the remaining provisions of the Local Law shall remain in effect.

Plain English

Section 132-2 of New Rochelle, N.Y., Code of Ordinances ch. 132 establishes a severability rule: if a court finds any single part of the chapter unconstitutional or otherwise legally invalid, that ruling does not bring down the rest of the chapter. The remaining provisions continue to operate as if the invalidated portion had never been included. This is a standard legal safeguard built into many local laws to preserve as much of the legislation as possible.

For Property Managers

Under ch. 132 § 132-2, the rent-related obligations that apply to property owners in New Rochelle are designed to survive a partial legal challenge. A compliant operator generally continues to follow all other provisions of the chapter even if a specific section is struck down by a court. Staying current with any court rulings affecting ch. 132 helps operators understand which requirements remain in force.

For Tenants

Section 132-2 means that tenant protections established elsewhere in ch. 132 are not automatically eliminated if one part of the chapter is successfully challenged in court. Rights and remedies under the remaining provisions stay intact and may still be raised or pursued through appropriate channels, such as a local rent board or tenant-rights organization. Tenants who are uncertain which provisions remain in effect following any legal challenge may wish to consult a tenant-rights organization familiar with New Rochelle housing law.
