Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-65
Notice to tenants
Operative Text
A. All leases offered to a tenant in a multiple dwelling must contain a notice, conspicuously set forth therein, which advises the tenant of the obligation of the landlord to install window guards and where further information regarding the procurement of such window guards is available. B. The landlord must cause to be delivered to each dwelling unit of a multiple dwelling a notice advising occupants of the obligation of such landlord to install window guards and where further information regarding the procurement of such window guards is available. Such notice must be provided on an annual basis in a form and manner approved by the Department. C. The landlord must cause to be delivered to each dwelling unit of a multiple dwelling, within 30 days of a change of occupancy not involving a written lease, a notice advising the occupants of the obligation of such landlord to install window guards and where further information regarding the procurement of such window guards is available.
Section 149-65 of Mount Vernon's Code of Ordinances requires that tenants in multiple dwellings receive clear written notice about their landlord's obligation to install window guards. This notice must appear in any written lease offered to a tenant, be delivered to every dwelling unit at least once a year in a Department-approved format, and be provided within 30 days whenever a unit changes occupancy without a written lease. The rule ensures tenants are informed both of the landlord's duty and of where they can get more information about obtaining window guards.
Plain English — not legal advice.
Under § 149-65, compliant operators in Mount Vernon multiple dwellings maintain a three-part notice practice: they include a conspicuous window-guard notice in every lease offered, deliver an annual notice to each dwelling unit in a form and manner approved by the Department, and send an additional notice within 30 days whenever a unit changes hands without a written lease. Keeping dated records of each delivery—whether by mail, hand delivery, or another approved method—helps demonstrate that all three notice requirements have been met. Operators typically confirm that the notice language and format align with current Department guidance before each annual distribution cycle.

Section 149-65 gives tenants in Mount Vernon multiple dwellings the right to receive written notice of their landlord's window-guard installation obligation in at least three situations: at lease signing, annually, and within 30 days of moving in without a written lease. If a tenant did not receive any of these required notices, that gap may be relevant to a broader window-guard complaint or code-enforcement matter. Tenants who believe this provision has not been followed can contact the Mount Vernon Department referenced in § 149-65, reach out to a local tenant-rights organization, or consult an attorney to understand what options may be available.
