Mount Vernon Code ch. 149 § 149-62 establishes penalties for violations of Chapter 149 that persist after a written notice or order to correct has been issued and the compliance deadline has passed. A violation that continues beyond that deadline—or beyond any extended deadline granted by the Commissioner—can result in a criminal fine of up to $500 per day, imprisonment of up to 15 days per day, or both. Separately, the City may pursue a civil action to recover a flat $500 penalty plus any costs the City incurred in abating the violation itself.

For Property Managers

Property owners, agents, and contractors operating under Mount Vernon Code ch. 149 § 149-62 generally act promptly upon receiving any written notice of violation, correcting the cited condition within the timeframe specified in the notice or as extended by the Commissioner. Compliant operators document their remediation efforts so they can demonstrate the violation was resolved before the compliance deadline, avoiding the per-day fine exposure that begins the moment that deadline lapses. Because civil liability for City abatement costs can stack on top of criminal penalties, operators typically treat written notices as time-sensitive obligations requiring immediate attention.

For Tenants

Under Mount Vernon Code ch. 149 § 149-62, tenants living in a building where a code violation exists may have grounds to raise the landlord's non-compliance as relevant context in housing proceedings, particularly if a notice of violation was issued and the deadline passed without correction. Tenants can contact the City of Mount Vernon's code enforcement office to inquire about the status of any outstanding notices or orders affecting their building. Tenant-rights organizations familiar with Westchester County housing law can help residents understand how ongoing violations and the penalties under § 149-62 may relate to their broader housing rights.
