Under Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-52, an owner who has received an official notice or order related to housing conditions cannot simply sell, transfer, mortgage, or lease the property and leave the new party unaware of outstanding violations. Before any such transaction can proceed, the owner must either bring the property into full compliance with the notice or order, or formally disclose the notice or order to the incoming party and notify the Commissioner of the pending transaction. Any buyer, transferee, mortgagee, or lessee who takes on the property is legally bound by any notice or order that was issued and filed under this chapter, regardless of when they became involved.

For Property Managers

Property owners and managers operating under Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-52 generally ensure that any outstanding housing notices or orders are resolved before a sale, transfer, mortgage, or lease is finalized. When full compliance is not yet achieved prior to a transaction, compliant operators provide the incoming party with a true copy of the relevant notice or order and simultaneously notify the Commissioner in writing, including the name and address of the prospective buyer, transferee, or lessee. Maintaining clear records of these disclosures and notifications helps demonstrate that the procedural requirements of § 149-52 were met at the time of the transaction.

For Tenants

Under Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-52, tenants and other incoming parties who acquire an interest in a property are legally bound by any housing notice or order that was previously issued and filed, meaning unresolved violations follow the property rather than disappearing upon a change of ownership or tenancy. If a tenant believes a landlord failed to disclose an existing notice or order before a lease was signed, that failure may itself constitute a violation of § 149-52 worth raising with the appropriate local authority. Tenants can contact the Mount Vernon housing office or a local tenant-rights organization to better understand what notices or orders may be on file for a property and what remedies may be available.
