Plain English

Section 149-5 of Mount Vernon's Code of Ordinances (ch. 149) establishes that any installation, alteration, or repair work done on residential property — along with the materials and equipment used — must be reasonably safe and must comply with applicable New York State law. The provision also creates a legal presumption: if the work meets the requirements of Mount Vernon's Building Code, that compliance serves as prima facie evidence that the work is reasonably safe to people and property.

For Property Managers

Under ch. 149 § 149-5, operators who undertake residential installations, alterations, or repairs generally ensure that all work and associated materials conform to both New York State statutes and the Mount Vernon Building Code. Aligning projects with the Building Code is significant because it establishes a prima facie presumption of reasonable safety, which can be relevant if the safety of the work is ever questioned. Compliant operators typically document permits, inspections, and material specifications to support that conformity.

For Tenants

Section 149-5 of Mount Vernon Code ch. 149 sets a baseline safety standard for any work performed on residential premises, meaning tenants have a basis to raise concerns when installations, alterations, or repairs appear unsafe or inconsistent with New York State requirements. If work in a rental unit seems to fall short of these standards, tenants can document the conditions and consider contacting the Mount Vernon Building Department or a local tenant-rights organization to understand available complaint processes. Raising a violation of § 149-5 may also be relevant as a defense or counterclaim in certain housing proceedings.
