Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-19
Prohibited accumulations
Operative Text
It is prohibited: A. To accumulate or store on residential premises, except in locations approved by the Fire Department, any highly flammable or explosive matter, such as paints, volatile oils, cleaning fluids and similar materials, or any combustible refuse liable to spontaneous combustion, such as wastepaper, boxes, rags or similar materials. B. To accumulate or store materials on fire escapes or stairs, in stairways or windows or in any other locations where in the event of fire such materials may obstruct egress of occupants or interfere with fire-fighting operations.
Section 149-19 of the Mount Vernon Code of Ordinances prohibits two categories of dangerous accumulations on residential properties. First, it bars the storage of highly flammable or explosive substances—such as paints, volatile oils, and cleaning fluids—as well as combustible refuse prone to spontaneous ignition, unless stored in a Fire Department-approved location. Second, it forbids placing any materials on fire escapes, stairs, stairways, windows, or other spots where those materials could block residents from exiting or hamper firefighting efforts during an emergency.

Operators of residential properties in Mount Vernon should be aware that § 149-19 sets clear expectations for how hazardous and combustible materials are managed on-site. Compliant operators generally ensure that flammable substances like paints and volatile oils are kept only in locations the Fire Department has approved, and that combustible refuse such as wastepaper, rags, and boxes does not accumulate anywhere on the premises. They also routinely verify that fire escapes, stairways, and windows remain clear of stored materials so that egress routes and firefighting access are never compromised.

Under § 149-19 of the Mount Vernon Code of Ordinances, tenants have an interest in knowing that their building's common areas, fire escapes, and stairways must be kept free of flammable materials and obstructions. If a tenant observes stockpiled combustible refuse, improperly stored flammable liquids, or blocked egress routes, they may report those conditions to the Mount Vernon Fire Department or the appropriate municipal code-enforcement office. Tenant-rights organizations familiar with local housing codes can help residents understand what documentation to gather and what complaint processes are available.
