Section 296-32 of Middletown, N.Y.'s Code of Ordinances establishes a fee structure tied to the city's rental permit program. Both initial permit applications and renewals carry a flat, nonrefundable fee of $100 per rental unit. When a property requires three or more inspections during the permitting or renewal process—because the owner failed to appear or correct violations after two scheduled visits—escalating reinspection fees of $50 for a third inspection and $100 for each subsequent inspection are assessed, provided the city's Department of Public Works gave reasonable written notice before each inspection.

For Property Managers

Operators subject to Middletown's rental permit program under § 296-32 generally budget $100 per unit at both the initial application and each renewal cycle, treating these as fixed, nonrefundable costs of compliance. Compliant operators also make it a practice to appear for all scheduled inspections and address cited violations promptly, since a third inspection triggers a $50 fee and a fourth—and any beyond that—triggers a $100 fee each. Keeping records of all written notices received from the Department of Public Works regarding inspection dates and times is a standard part of managing permit files under this section.

For Tenants

Section 296-32 of Middletown's Code of Ordinances is relevant to tenants because the rental permit process it funds is designed to ensure rental units meet local standards. If a landlord's property is subject to repeated reinspections due to uncorrected violations, the escalating fee structure under this provision creates a financial incentive for owners to address those issues. Tenants who believe their unit has unresolved code violations may find it useful to contact the Middletown Department of Public Works or a local tenant-rights organization to understand how the permit and inspection process applies to their building.
