For Property Managers

Chapter 249, § 249-3 of the Middletown Code of Ordinances creates an exemption that applies to property owners with no more than one rental unit statewide. Compliant operators who believe they qualify as a 'small landlord' under this provision generally document their total unit holdings across New York State to support that classification. Because the exemption turns on a statewide unit count rather than just local holdings, operators with properties in multiple New York municipalities typically account for all of them when assessing whether this definition applies.

For Tenants

Section 249-3 of Middletown's Chapter 249 determines which landlords are subject to the chapter's protections and which are not, based on how many units the landlord owns across New York State. If a landlord claims the 'small landlord' exemption, tenants may want to verify whether that landlord truly owns no more than one unit statewide, since the exemption is tied to that specific threshold. Tenants with questions about whether their landlord qualifies for this exemption can reach out to a local tenant-rights organization or the City of Middletown for guidance on how the provision applies.
