Posting of trash/refuse policy; notification to tenants of “Property Maintenance by Tenants” ordinance
Operative Text
A. The Department of Public Works' trash/refuse policies and procedures shall be conspicuously posted in all rental buildings by the owner. B. The landlord shall receive an initial fine of $100 if the Department of Public Works' trash/refuse policies and procedures are not conspicuously posted in any rental building owned by the owner. Should such notice thereafter not be conspicuously posted, a fine of $250 shall be imposed against the owner. C. The landlord shall provide each tenant with a copy of the City of Kingston "Property Maintenance by Tenants" ordinance (Chapter 333 of the Code of the City of Kingston) at the time the tenant executes a rental lease or when the tenant initially takes occupancy of the rental property, whichever event occurs sooner. The receipt of a copy of Chapter 333 should be acknowledged by the tenant in writing, and such writing shall be retained by the landlord. D. Failure to comply with the provisions of § 332-10C shall result in the landlord being subject to a fine of $100.
Kingston, N.Y., Code of Ordinances ch. 332 § 332-10 establishes two related posting and notification requirements for rental properties. First, owners must display the Department of Public Works' trash and refuse policies and procedures in a conspicuous location within every rental building. Second, landlords must give each tenant a copy of the City of Kingston's 'Property Maintenance by Tenants' ordinance (Chapter 333) at or before the start of occupancy, and must keep a written acknowledgment signed by the tenant confirming receipt.

Under § 332-10, compliant rental property operators post the Department of Public Works' trash and refuse policies and procedures in a visible location in every building they own. They also provide each incoming tenant with a copy of Chapter 333 of the Kingston City Code at lease signing or move-in—whichever comes first—and retain a written, tenant-signed acknowledgment of that delivery. Failure to maintain the required posting can result in an initial fine of $100, rising to $250 for continued non-compliance, and failure to deliver the Chapter 333 notice carries a separate $100 fine.

Section 332-10 gives tenants the right to receive a copy of Kingston's 'Property Maintenance by Tenants' ordinance (Chapter 333) before or at the start of their tenancy, and their landlord is required to keep a written record of that delivery. If a landlord does not fulfill this obligation, they are subject to a $100 fine under § 332-10D. Tenants who believe this requirement has not been met may contact the City of Kingston to report the concern or consult a local tenant-rights organization to understand available options.
