Operative Text
A. In the event that the owner of a rental property does not reside within 20 miles of the City limits, or if the owner is not a natural person, such owner shall be required to designate a managing agent. B. The managing agent shall be a natural person, 18 years of age or older, who actually resides within 20 miles of the City limits or has a regular place of business within 20 miles of the City limits. C. The managing agent shall be designated by the owner as the person responsible for and in control of the maintenance and operation of such rental property, and upon whom process may be served on behalf of the owner. D. Nothing contained in this section shall be construed as preventing a corporation which is an owner of real property from designating as its managing agent with respect thereto any officer of such corporation who meets the requirements of this subsection as to location of the residence or the place of transacting business of the managing agent. E. Any designation as managing agent made pursuant to the provisions of this section shall remain in full force and effect until changed or terminated as herein provided.
Section 237-6 of Johnstown, N.Y., Code of Ordinances ch. 237 requires certain rental property owners to formally designate a managing agent when they live more than 20 miles from the City or are not an individual person (such as a corporation or LLC). The designated managing agent must be an adult individual who either lives or maintains a regular place of business within 20 miles of Johnstown's City limits. Once made, the designation stays in effect until it is formally changed or ended, and the agent can legally receive court or legal process on the owner's behalf.
Plain English — not legal advice.
Under § 237-6, property owners who are entities (such as corporations or LLCs) or who reside more than 20 miles from Johnstown's City limits are expected to have a qualifying managing agent on file at all times. Compliant operators typically ensure their designated agent is an adult individual with a residence or regular business location within the 20-mile radius, and they update that designation promptly whenever the agent changes. Corporate owners should note that § 237-6(D) expressly permits designating a qualifying corporate officer to fill this role, provided that officer meets the location requirements.

Section 237-6 establishes that qualifying rental property owners in Johnstown must have a local managing agent who can be served with legal process on the owner's behalf, giving tenants a reachable point of contact for maintenance and operational matters. If a landlord appears to lack a properly designated managing agent as required by § 237-6, tenants may raise that as a concern when dealing with the City or when pursuing remedies related to the property. Tenant-rights organizations or local housing offices can help tenants understand how this designation requirement intersects with other rights and complaint processes available to them.
