Jamestown, N.Y., Code of Ordinances ch. 216 § 216-3
Exemptions
Operative Text
All rental housing units shall be subject to the requirements of this chapter, except for the following: A. Rental housing units for transient lodging, including hotels, motels, inns, tourist homes. This exception does not apply to residential hotels. B. Rental housing units in a state-licensed hospital, hospice, community care facility or nursing home; convent, monastery, or other facility occupied exclusively by members of a religious order; on-campus fraternity or sorority houses; or on-campus housing accommodations owned, operated, or managed by an institution of higher education or secondary school for occupancy by its students. C. Rental housing units that are owned, operated by, or receive funding or subsidies from federal, state, or local government entities and are inspected by the governmental entity at least once every five years.
Section 216-3 of Jamestown, N.Y., Code of Ordinances ch. 216 establishes which rental housing units fall outside the scope of the chapter's requirements. Transient lodging such as hotels, motels, inns, and tourist homes is excluded, though residential hotels remain covered. Also excluded are units in state-licensed medical or religious facilities, on-campus fraternity and sorority houses, and on-campus student housing run by educational institutions. Finally, government-owned, -operated, or -subsidized units that receive an official inspection at least once every five years are likewise exempt.

Operators of rental housing in Jamestown should confirm whether their properties fall within the exemptions listed in § 216-3 before assuming the chapter's requirements do not apply. Owners of residential hotels, for example, should note that the transient-lodging exemption explicitly excludes them, meaning full compliance with ch. 216 is expected. Operators of government-assisted properties who rely on the subsidy exemption generally maintain documentation showing that the required governmental inspection occurs at least once every five years.

Section 216-3 of Jamestown's ch. 216 defines the boundaries of tenant protections under the chapter, so renters benefit from understanding whether their unit is covered or exempt. Tenants in residential hotels retain coverage even though other transient lodging is excluded, and tenants in privately owned, non-subsidized housing are generally covered unless another specific exemption applies. Renters who are uncertain about their unit's status may contact the City of Jamestown's relevant housing office or a local tenant-rights organization for general information about how the exemptions are applied.
